O Plenário do Senado Federal aprovou nesta quarta-feira (18) o projeto de lei 2.942, de 2024, que determina o uso de tornozeleira eletrônica por agressores em caso de violência doméstica como medida protetiva autônoma. O texto agora vai à sanção presidencial.
De acordo com a proposta, quando identificado risco "atual ou iminente à vida ou à integridade" da vítima e de seus dependentes, o agressor poderá ser submetido ao monitoramento. O PL também concede poder a delegados de polícia para decretar o uso do equipamento. Nesse caso, o Ministério Público deve ser comunicado em até 24 horas sobre a decisão.
Casos nos quais as medidas protetivas anteriores foram descumpridas terão prioridade. O texto define que o agressor deve ser comunicado sobre o funcionamento da tornozeleira eletrônica e as áreas em que está impedido de circular. Se o "perímetro de exclusão for rompido", o sistema de monitoramento deve emitir alerta simultâneo à vítima e à unidade policial mais próxima. O PL determina aumento de pena se o agressor circular em regiões proibidas e violar ou remover o equipamento sem autorização judicial.
O texto dispõe também sobre ações de enfrentamento à violência doméstica. A proposta define que campanhas devem "contemplar informações sobre procedimentos e abordagens policiais, prevenção à revitimização e funcionamento das medidas protetivas de urgência e mecanismos de monitoração eletrônica".
Outra determinação é a alocação de recursos para adquirir os equipamentos de vigilância de agressores e de segurança para as vítimas e para fazer a manutenção dos dispositivos. Além disso, a proposta estabelece o aumento de 5% para 6% da parcela de verbas do Fundo Nacional de Segurança Pública (FNSP) destinadas às ações de enfrentamento à violência contra a mulher.
