A Câmara dos Deputados aprovou nesta 4ª feira (18.mar.2026) o PL (Projeto de Lei) 3880 de 2024 que altera a Lei Maria da Penha para incluir a violência vicária dentre as definições de violência doméstica e familiar. O texto segue para o Senado.
Violência vicária se trata de qualquer forma de violência praticada contra filho, dependente ou mesmo outro parente ou pessoa da rede de apoio da mulher visando a atingir a mulher.
O texto, de autoria das deputadas Laura Carneiro (PSD-RJ), Maria do Rosário (PT-RS) e Fernanda Melchionna (PSOL-RS), estabelece pena de reclusão entre 20 e 40 anos.
A medida se aplica quando o crime é cometido contra descendentes, ascendentes, dependentes ou enteados da mulher com o objetivo específico de causar-lhe sofrimento, punição ou controle doméstico.
A pena pode ser elevada se o assassinato for praticado na presença da mulher, contra crianças, adolescentes, idosos e pessoas com deficiência, ou ainda se o agressor estiver descumprindo medida protetiva no momento do crime.
Na justificativa, a relatora da proposta, deputada Silvye Alves (União Brasil-GO) citou um caso recente de violência vacária, no interior de Goiás. No dia 11 de fevereiro, o secretário de Governo da prefeitura de Itumbiara, Thales Machado, atirou contra os 2 filhos na residência onde morava e, em seguida, tirou a própria vida.
Um dos meninos, de 12 anos, morreu antes que pudesse ser socorrido. O irmão mais novo, de 8 anos, foi levado ao hospital em estado gravíssimo, mas morreu 2 dias depois.
