No entanto, vídeos que circularam nas redes sociais mostram uma festa acontecendo no espaço no domingo, 8 de fevereiro. O embargo, determinado pelo Iphan em 21 de janeiro, foi motivado pela "integral supressão" de vegetação de restinga e pela construção de "módulos construtivos de grandes dimensões" sem a devida autorização. A obra, conduzida pela Milo Investimentos S.A., está localizada em uma área de proteção ambiental e em um conjunto arquitetônico e paisagístico tombado desde 1974.
Procurado para comentar a realização da festa no local embargado, um dos responsáveis pelo empreendimento, identificado como Genaro Campos, afirmou que a licença de funcionamento do estabelecimento está ativa e é anterior ao embargo da obra. "A obra está embargada, minha licença de funcionamento não", declarou. Segundo ele, o alvará foi emitido no ano passado pela prefeitura de Porto Seguro. "Eu tenho alvará de funcionamento desde o ano passado. Antes do embargo", reforçou, acrescentando que a situação da obra está em processo de regularização.

A licença, de tipo anual, teve validade até 31 de dezembro de 2025 e classifica a atividade principal como "bares e outros estabelecimentos especializados em servir bebidas, com entretenimento", além de prever atividades secundárias como "casas de festas e eventos". Segundo Genaro, existe uma outra licença de funcionamento com validade até agosto de 2026.
A situação revela um aparente conflito administrativo: embora a construção esteja irregular e paralisada por ordem dos órgãos de fiscalização, o estabelecimento alega possuir uma licença municipal para operar.
A família Vorcaro, proprietária do empreendimento avaliado em até R$ 25 milhões, é figura central em um dos maiores escândalos financeiros recentes do país. Henrique Moura Vorcaro e sua filha, Natalia Bueno Vorcaro Zettel, diretores da Milo Investimentos, foram alvos da Operação Compliance Zero da Polícia Federal, que investiga desvios de recursos do Banco Master. Henrique é pai de Daniel Vorcaro e Natalia, além de irmã de Daniel, é esposa de Fabiano Zettel, ambos figuras centrais na investigação.
