Seis adultos e dois adolescentes teriam cometido o crime no sábado
O juízo da Central de Audiência de Custódia de Benfica manteve nesta segunda-feira, 23, a prisão de seis homens detidos no último sábado, 21, por agredir uma capivara. O crime ocorreu na Ilha do Governador, zona norte do Rio.
Os detidos tiveram a prisão em flagrante convertida em preventiva. Os detidos são: Wagner da Silva Bernardo, Matheus Henrique Teodosio, Paulo Henrique Souza Santana, Pedro Eduardo Rodrigues, José Renato Beserra da Silva e Isaias Melquiades Barros da Silva.
Segundo a denúncia, os seis, junto com dois adolescentes, são acusados de agredir violentamente uma capivara, utilizando barras e ripas de madeira, algumas, inclusive, com pregos.
As agressões teriam ocorrido durante a madrugada do último sábado na Rua Repouso, no Jardim Guanabara, na zona norte do Rio. Os oito acusados foram localizados e presos ainda no dia do crime ambiental contra a capivara.
Já os dois adolescentes, que estavam juntos com os seis homens na sessão de espancamento contra a capivara, tiveram as internações provisórias determinadas no domingo, 22, pela Vara da Infância e da Adolescência da Capital.
"A gravidade em concreto do delito demonstra a necessidade da prisão cautelar para a garantia da ordem pública. As imagens amplamente divulgadas pela mídia e que circulam nas redes sociais revelam a extrema crueldade do crime praticado. Ante o exposto, converto a prisão em flagrante em prisão preventiva", determinou o juiz Rafael Rezende.
Na decisão, o magistrado também ressaltou a crueldade e os meios empregados pelos acusados na agressão ao animal.
"A pluralidade de agentes, o envolvimento de adolescentes no crime, o potencial lesivo dos instrumentos usados no crime (pedaços de madeira, alguns deles contendo pregos) e a diversidade de golpes desferidos, capazes de causar intenso sofrimento físico ao indefeso animal, aumentam a reprovabilidade da conduta dos custodiados".
O juiz negou os pedidos das defesas dos acusados de liberdade provisória por terem residência fixa e serem réu primários.
