Senado Federal aprova projeto que torna misoginia crime
O texto, da senadora Ana Paula Lobato, que ganhou substitutivo de Soraya Thronicke (Podemos-MS), define a misoginia como "a conduta que exteriorize ódio ou aversão às mulheres".
O projeto também inclui a expressão "condição de mulher" entre os critérios de interpretação da Lei do Racismo, ao lado de cor, etnia, religião e procedência.
A legislação atual equipara a misoginia à injúria e à difamação e a pena pode chegar a até um ano de reclusão, de acordo com o Código Penal (arts. 139 a 141). Para evitar possíveis conflitos de interpretação, Soraya apresentou uma emenda para que o Código Penal passe a reger tão somente a injúria no contexto de violência doméstica e familiar, e não a injúria misógina.
"O projeto é para proteger a família e a dignidade e a liberdade das mulheres. A aprovação do projeto responde a uma realidade urgente. O ódio às mulheres não é abstrato: é estruturado, é crescente e ceifa vidas todos os dias", afirmou Soraya.
A matéria já havia sido aprovada, em dezembro de 2025, na Comissão de Constituição e Justiça (CCJ) de forma terminativa, o que significa que o texto iria direto para a Câmara dos Deputados.
No entanto, houve um recurso para que fosse ao Plenário. A votação, inicialmente prevista para a semana passada, chegou a ser adiada, na tentativa de um acordo.
