O salário bruto médio mensal dos magistrados da justiça estadual brasileira foi de R$ 99 mil em 2025. O levantamento, publicado nessa terça-feira (24/3), foi feito pelas organizações Transparência Brasil e República.org.
De acordo com o estudo, os tribunais de justiça estaduais pagaram mais de R$ 10,7 bilhões acima do teto constitucional em 2025.
A análise aponta que 98% dos magistrados receberam valores além do limite permitido, que é R$ 46.366,19 mensal. Um a cada quatro magistrados recebeu R$ 1 milhão acima do teto no acumulado do ano.
O Tribunal de Justiça de São Paulo (TJ-SP) é o principal responsável por esses números, com 3.039 de seus membros (88% do órgão) recebendo acima de R$ 1 milhão extrateto. O maior valor total pago acima do teto para um único magistrado durante todo o ano de 2025 foi de R$ 2,8 milhões a uma juíza do Piauí.
Esse fenômeno é impulsionado por "penduricalhos", como pagamentos retroativos e licenças compensatórias, que elevam os salários médios a patamares muito superiores ao permitido pela Constituição.

Nesta quarta-feira (25/3), o STF retoma o julgamento sobre o pagamento de verbas indenizatórias a membros de Poderes sem previsão expressa em lei. Os pagamentos foram suspensos por liminares dos ministros Flávio Dino e Gilmar Mendes. Agora, os ministros avaliam se vão manter a decisão ou não.
Eles devem se basear em uma nota técnica feita por uma comissão criada pela Corte para apresentar propostas em relação aos penduricalhos no Judiciário. A comissão identificou que foram gastos R$ 9,8 bilhões com penduricalhos para a magistratura. No caso do Conselho Nacional do Ministério Público (CNMP), foram R$ 7,2 bilhões.
O documento propõe soluções transitórias e estruturais. No primeiro caso, seria a adoção da legislação do Imposto de Renda como parâmetro para definir verbas indenizatórias. Mas, a longo prazo, a solução seria uma definição clara do que é verba remuneratória e o que é efetivamente indenizatória, a criação de mecanismos para reajustar a remuneração de base de forma automática e a implementação de sistemas que permitam a fiscalização comparativa de todos os pagamentos em todos os níveis da federação.
