Fachin diz que Moraes está disposto a encerrar inquérito das fake news
O presidente do Supremo Tribunal Federal (STF), Edson Fachin, afirmou nesta terça-feira (31) que a Corte discute a possibilidade de encerrar o inquérito das fake news, relatado pelo ministro Alexandre de Moraes. A investigação completou sete anos de tramitação no último dia 14.
O caso é alvo de críticas de juristas e entidades que questionam sua duração e formato. "Esse é um assunto que me preocupa. É preciso lembrar que eu fui o relator da ADPF que discutiu a constitucionalidade do inquérito", disse Fachin, em referência ao julgamento que validou a investigação em 2020.
"O voto que eu apresentei concluiu pela constitucionalidade", acrescentou. Na ocasião, o ministro ressaltou que "todo o remédio, a depender da dosagem, pode se transformar em veneno".
"Mas é o momento de pensar no encerramento desse tipo de atividade", acrescentou o ministro, em conversa com jornalistas, nesta tarde, sobre os seis meses de sua gestão. A declaração foi divulgada pelo Estadão.
Segundo Fachin, Moraes se mostrou disposto a debater o fim do inquérito das fake news. "Eu já conversei sobre esse tema com o relator e tenho iniciado conversas com os demais ministros. Portanto, é um assunto que está na pauta. O ministro Alexandre de Moraes se mostrou disposto ao encerramento deste inquérito", disse.
No último dia 23, a Ordem dos Advogados do Brasil (OAB) pediu ao presidente do STF o encerramento do inquérito. A entidade destacou que "o momento nacional recomenda contenção, estabilidade e compromisso ativo com a pacificação institucional".
"Sejam adotadas providências voltadas à conclusão dos chamados inquéritos de natureza perpétua, em especial daqueles que, por sucessivos alargamentos de escopo e prolongamento temporal, deixam de ostentar delimitação material e temporal suficientemente precisa, bem como que não haja a instauração de novos procedimentos com essa mesma conformação expansiva e indefinida", disse a OAB.
