A diminuição foi de 36,3%, com o passivo caindo de R$ 3,43 trilhões em 2022 para R$ 2,18 trilhões no ano passado, um decréscimo de 36,36%.
A AGU é responsável por defender a União em ações no Judiciário e monitorar possíveis bombas fiscais. Para isso, tem instância como a Secretaria-Geral de Contencioso, a Procuradoria-Geral da União, a Procuradoria-Geral Federal e a Procuradoria-Geral da Fazenda Nacional.
"Nossa atuação dedicada e estratégica, focada na melhoria da governança dos riscos, evitará o pagamento de R$ 1,25 trilhão em precatórios", diz o advogado-geral da União, Jorge Messias. "São recursos expressivos que agora poderão ser utilizados em ações e programas de políticas públicas de áreas essenciais para a população, como saúde, segurança e educação", acrescenta.
Apenas em 2025, o decréscimo no risco fiscal foi de 16,32%, ou R$ 425,4 bilhões, segundo a AGU.
Entre as decisões favoráveis listadas pelo órgão governamental está o acolhimento pelo STF de proposta para a correção das contas vinculadas ao FGTS, estabelecendo remuneração que garanta o índice oficial de inflação (IPCA). Apenas essa ação evitou rombo estimado em R$ 259,9 bilhões.
Outro exemplo foi a decisão do STF de manter o limite da dedução de despesas com educação do cálculo do Imposto de Renda de Pessoa Física. O processo apresentava potencial impacto de R$ 114,9 bilhões aos cofres públicos.
A AGU lista ainda decisão do STF que manteve as regras do Regime Especial de Reintegração de Valores Tributários para as Empresas Exportadoras (Reintrega). Caso as ações fossem julgadas procedentes, o impacto nas contas públicas, estimado pela Receita Federal, seria de cerca de R$ 50 bilhões.
