Um levantamento divulgado nesta quinta-feira, 12, pela Genial/Quaest mostra que a maioria dos brasileiros (82%) apoia a implementação de um Código de Conduta para os ministros do Supremo Tribunal Federal (STF). A pesquisa ouviu 2.004 pessoas entre os dias 5 e 9 de fevereiro e tem uma margem de erro de 2 pontos percentuais, para mais ou para menos.
A adesão mais firme à ideia está nos estados do Sul (86%) e do Sudeste (84%). Também há uma diferença considerável no recorte etário. Entre os mais jovens (16 a 34 anos), 85% são a favor do Código de Conduta, enquanto entre os mais velhos (pessoas com 60 anos ou mais), esse percentual cai para 74%. Nos outros recortes feitos pela pesquisa, a adesão mais alta à ideia está entre as pessoas de direita que não se consideram bolsonaristas: 92% dos entrevistados desse grupo acreditam que o Código de Conduta é importante e deveria ser criado.
Logo quando assumiu a presidência do Supremo, o ministro Edson Fachin começou a costurar nos bastidores a elaboração de um Código de Conduta para a Corte — hoje, os ministros, como são magistrados, obedecem à Lei Orgânica da Magistratura (a Loman), mas não têm uma entidade fiscalizadora, como é o Conselho Nacional de Justiça (CNJ) para os membros das instâncias inferiores. Apesar da resistência interna, no dia em que foram retomados os trabalhos do Supremo, Fachin designou a ministra Cármen Lúcia para ser relatora da discussão.
O debate ganhou mais tração com as repercussões negativas pela condução de Dias Toffoli no inquérito do Banco Master. Nesta quarta, 11, a Polícia Federal pediu a Fachin a suspeição dele, diante de mensagens que foram encontradas no celular do banqueiro Daniel Vorcaro mencionando o ministro. Toffoli divulgou uma nota nesta quinta, 12, confirmando que é sócio dos irmãos em um fundo que vendeu cotas do resort Tayayá, no Paraná, a outro fundo gerido por familiares do dono do Master. Fachin antecipou o fim da sessão desta quinta e convocou uma reunião com os ministros para discutir o caso.
