Na decisão, a magistrada apontou que "não restou demonstrada" a necessidade de o médico cumprir prisão domiciliar para cuidar dos dois filhos menores de idade, visto que "inexistem provas" de que as crianças dependam exclusivamente dos cuidados do suspeito.
"A palavra da vítima apresenta especial relevo como elemento de convicção do magistrado. É imprescindível o decreto da prisão preventiva de forma a resguardar a vítima e a ordem pública", afirmou a juíza em um dos trechos da decisão.
