O ministro do STF, Alexandre de Moraes, abriu de ofício uma investigação na Receita Federal para apurar quem vazou informações fiscais dos juízes da Suprema Corte. Sem sombra de dúvidas, vazamento de dados sigilosos, protegidos por lei, é crime.
No entanto, chama a atenção o rigor para esse tipo de conduta, extrapolando prerrogativas legais, enquanto para outras não ocorre o mesmo tipo de tratamento.
A começar pela normalidade do caso Master ser julgado pelo STF, com a participação de ministros com conflitos de interesse no processo, tais como o recebimento de R$129 milhões do banco para a esposa de um dos togados e o aporte de R$35 milhões de fundos ligados à instituição financeira de Vorcaro para a empresa de Toffoli.
Apesar do bom senso dizer que o ideal seria o afastamento dos ministros do caso, a corte dobrou a aposta, reafirmando que não há conflito de interesse, apesar de ter optado pelo afastamento de Dias Toffoli do cargo. Ora, se não havia problema, por que afastaram?
Outra incoerência foi abertura de investigação de ofício pelo ministro Moraes dentro do interminável e infinito inquérito das fake news. A abertura de inquérito deveria ocorrer com provocação da PGR e somente poderia ser autorizada pelo presidente do STF, Edson Fachin.
Mas ultimamente a forma, base do Direito, tem sido deixada de lado. Seria bem-vindo que o mesmo rigor observado contra os fiscais da Receita fosse adotado nas investigações do Banco Master, sem poupar membros do poder Judiciário e políticos, e nem interesses corporativistas.
