México aprova redução da jornada de trabalho para 40 horas

A Câmara dos Deputados do México aprovou a redução gradual da jornada semanal de trabalho para 40 horas até 2030. Na madrugada desta quarta-feira (25/02), a nova lei obteve unanimidade entre os 469 parlamentares presentes na Casa Legislativa, composta por 500 representantes.
Desde a Constituição de 1917, a jornada laboral no México é limitada a 48 horas e a mudança irá beneficiar 13,5 milhões de trabalhadores. A proposta, já aprovada no Senado, foi encaminhada ao Congresso, pela presidente Claudia Sheinbaum, em dezembro de 2025, após várias reuniões com organizações sociais, sindicatos e empresários.
A nova lei não prevê uma redução abrupta da jornada, mas progressiva, com a diminuição de duas horas trabalhadas por ano até 2030. Segundo o partido Morena, isso permitirá a reorganização dos turnos, evitando choques abruptos nos custos trabalhistas, em particular, para as micro e pequenas empresas.
A reforma, detalha a legenda governista, evitará acúmulo excessivo de horas na semana de trabalho e dará segurança jurídica em relação às horas extras, que foram limitadas em 12 horas semanais, excluindo a participação de trabalhadores menores de 18 anos.
Para entrar em vigor em janeiro de 2027, a nova lei ainda precisará ser aprovada por mais da metade das assembleias estaduais de todo o país.
Escala 6X1 permanece
Embora a redução da jornada tenha sido aprovada por todos os parlamentares presentes, ela recebeu fortes críticas ao não alterar a escala de trabalho semanal no país, permitindo a continuidade do regime 6×1.
O texto aprovado estabelece que "a jornada de trabalho será de 40 horas semanais, nos termos estabelecidos pela Lei Federal do Trabalho", mantendo apenas a obrigação das empresas de conceder "pelo menos" um dia de descanso.
Os partidos da oposição, como PAN, PRI e MC, insistiram que a alteração deveria assegurar dois dias de folga para cada cinco trabalhados, mas foram derrotados na votação. Para a deputada Annia Gómez Cárdenas (PAN), "40 horas distribuídas em seis dias não transformam nada".
A coordenadora do MC, Ivonne Ortega, também criticou a manutenção da escala 6×1, informa La Jornada: "vocês acham que todos, como alguns parlamentares, podem trabalhar enquanto jogam padel? Que podem pintar o cabelo durante o expediente ou pedir licença do trabalho para participar de um reality show?", provocou.
O governo prometeu rediscutir o tema em uma lei complementar.
