Nunes Marques foi o mais radical: votou para rejeitar a ação e absolver todos os envolvidos por considerar que as contratações não afetaram o equilíbrio das eleições nem tiveram motivação comprovadamente eleitoral.
O voto de André Mendonça teve mais nuances. O ministro considerou que houve irregularidades graves nas contratações temporárias, mas concluiu que Cláudio Castro não teve responsabilidade sobre elas. "Embora tenha colhido os dividendos eleitorais, o que justificaria a sua cassação, caso não tivesse havido a renúncia ocorrida na data de ontem, não se aplica a sanção de inelegibilidade por insuficiência probatória de sua efetiva participação nas condutas ilícitas", argumentou.
Segundo o ministro, embora o então governador tenha sancionado a lei e editado o decreto que permitiu as contratações, não há provas de que ele tivesse "ciência, anuência, determinação ou participação" em irregularidades. "Sem descartar que a aplicação desvirtuada dessas normas, circunstância que não está na esfera de atribuição do chefe do Poder Executivo, possa ter favorecido as irregularidades detectadas, fato é que são atos em si hígidos e que não induzem de forma objetiva e automática a participação do governante", justificou.
