O Conselho Nacional de Justiça comunicou nesta segunda-feira (30) o afastamento do desembargador Alexandre Victor de Carvalho, do Tribunal de Justiça de Minas Gerais (TJMG), da ação de recuperação judicial da 123 Milhas. Segundo informou o órgão, a Corregedoria Nacional apura "graves indícios de irregularidades e favorecimento na condução do processo".
"Os elementos colhidos apontam um padrão de atuação que aparentemente extrapola a simples divergência jurídica, configurando, em tese, violação dos deveres funcionais da magistratura", afirmou o CNJ em nota.
O órgão ainda determinou uma correição extraordinária no gabinete do desembargador. Por meio do procedimento administrativo, a Corregedoria irá verificar o cumprimento das normas legais e regimentais e apurar a conduta do magistrado e sua equipe.
Conforme informou o CNJ, o TJMG foi notificado da decisão do órgão para designar um substituto de Alexandre Victor de Carvalho no processo a fim de "garantir" que "não haja interrupção na prestação jurisdicional à sociedade".
