O motorista foi preso em flagrante e logo depois a sua prisão foi convertida em preventiva. Em depoimento à Justiça ele admitiu o envolvimento no acidente, alegando ter perdido o controle da motocicleta ao desviar de uma pedestre e confirmou ter bebido no dia. Na sentença é dito que o réu "agiu de forma imprudente".
Uma das crianças sofreu politrauma e apresentou graves sequelas visuais, dor crônica, perda de dentes e prejuízo permanente na mastigação e fala.
