O foragido internacional Marcos Panissa foi capturado na tarde de quarta-feira (15) em ação conjunta da Polícia Nacional do Paraguai, a Polícia Federal, o Gaeco/PR e a Polícia Militar do Paraná. Panissa é condenado pela morte da ex-esposa Fernanda Estruzani Panissa, ainda em 1989, após golpear 72 facadas contra ela por ciúmes.
Com base em informações compartilhadas pela Polícia Federal brasileira, o condenado foi preso em San Lorenzo, no interior do Paraguai, após ser procurado pela Justiça brasileira há anos.
Ainda na quarta-feira, ele foi entregue às autoridades do Brasil na Ponte da Amizade, em Foz do Iguaçu, no Paraná. A ação aconteceu por meio do Comando Tripartite, estrutura de cooperação policial internacional sediada na região de fronteira.
O criminoso estava foragido desde 1995 e presente na lista de Difusão Vermelha da INTERPOL. Ele vivia no interior do Paraguai, com identidade falsa, uma nova família e rotina considerada discreta pelas autoridades.
A PF informou que Panissa já se encontra sob custódia e agora dará "cumprimento ao mandado de prisão e adotará as providências legais cabíveis".
Entenda o caso
Na época, o crime aconteceu em Londrina, no norte do Paraná. Panissa chegou a confessar ter matado Fernanda Estruzani Panissa por ciúmes, por não aceitar o fim do relacionamento. Ele tinha 23 anos, e a vítima, 21.
Já em 1991, Marcos foi condenado a 20 anos e 6 meses de prisão pelo crime. Houve um protesto por novo júri — recurso requerido pela defesa que permitia a realização de um novo julgamento quando a condenação fosse igual ou superior a 20 anos, mas o pedido foi revogado em 2008.
Um novo julgamento aconteceu no ano seguinte e Panissa foi condenado a 9 anos de prisão. O Ministério Público recorreu ao resultado e o júri foi anulado com base em uma composição irregular do mesmo e por decisão em desacordo com as provas apresentadas. Ao mesmo tempo, Panissa respondia ao processo em liberdade.
Já no terceiro julgamento, em 1995, Panissa não compareceu ao tribunal e teve a prisão preventiva decretada, mas já estava foragido.
Em 2008, mais uma sessão do Tribunal do Júri foi convocada devido a uma mudança na lei, que permitiu que o julgamento acontecesse mesmo sem a presença do réu para o júri. Com o novo, e último julgamento, ele foi condenado a 21 anos e 6 meses de prisão. A decisão, porém, ainda foi diminuída para 19 anos e seis meses de prisão em 2010.
