Após a decisão do TSE, a defesa de Bacellar recorreu ao Supremo e pediu a decretação de efeito suspensivo da decisão que condenou o ex-deputado.
Ao analisar o caso, o relator, ministro Cristiano Zanin, negou o pedido por razões processuais. O ministro entendeu que ainda cabe recurso contra a decisão, e o caso não justifica a concessão de uma medida liminar.
"Diante dos fundamentos da decisão agravada e pelo fato de não ter ocorrido nenhuma mudança em relação a situação processual quanto à interposição de eventual recurso extraordinário e de seu juízo de admissibilidade pelo Tribunal Superior Eleitoral, entendo ser o caso de manter a negativa da medida cautelar por seus próprios fundamentos", afirmou.
O voto foi seguido pelos ministros Alexandre de Moraes e Flávio Dino. Falta o voto da ministra Cármen Lúcia.
