Apesar das ressalvas, a Justiça entendeu que o deferimento da recuperação judicial é a medida mais adequada neste momento, para evitar a desorganização generalizada do passivo e preservar a atividade econômica.

"O indeferimento do pedido traria a consequente insolvência do grupo motivada por execuções individuais", diz a decisão, ao destacar o risco de prejuízo coletivo aos credores.

Com o processamento aprovado, ficam suspensas por 180 dias as execuções contra o grupo, período em que a Fictor deverá apresentar seu plano de recuperação judicial.
