O ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes determinou nesta quarta-feira (22) a prorrogação por mais 60 dias do inquérito que investiga o influenciador Bruno Monteiro Aiub, conhecido como "Monark".
A decisão atende a um pedido da Polícia Federal, que solicitou prazo adicional para concluir a análise do material coletado. A investigação apura a suposta prática do crime de desobediência a decisão judicial.
O inquérito foi instaurado após o 8 de janeiro de 2023 e mira perfis que "instigaram e divulgaram os atos criminosos investigados". A PF afirmou que o atraso no relatório final deve-se à "magnitude imprevista do acervo digital" processado pela equipe técnica.
A autoridade policial destacou que o sistema de peticionamento eletrônico do STF, embora eficiente para textos, possui limitações para o manejo de provas digitais brutas em formatos diferentes de PDF.
Essa limitação tecnológica exige que os agentes realizem coletas manuais e unitárias dos arquivos, o que foi descrito pela autoridade policial como um "gargalo logístico" para a celeridade das investigações.
Em 2023, Moraes determinou o bloqueio de diversos perfis de Monark em plataformas como Twitter, Instagram, Rumble e YouTube por, supostamente, "instigar atos criminosos".
"A criação de novos perfis se revela como um artifício ilícito utilizado para produzir (e reproduzir) conteúdo que já foi objeto de bloqueio nestes autos, veiculando novos ataques, violando decisão judicial, o que pode caracterizar, inclusive, o crime de desobediência (art. 359 do Código Penal)", disse Moraes ao determinar a investigação, em julho de 2023.
O ministro só autorizou o desbloqueio das redes sociais em fevereiro do ano passado. Em depoimento à polícia, o influenciador chegou a afirmar que não teria cumprido as decisões mesmo se tivesse sido intimado oficialmente, por considerá-las "inconstitucionais".
Na fundamentação de suas decisões, o ministro tem reiterado que a liberdade de expressão não é um "escudo protetivo" para a "prática de discursos de ódio, antidemocráticos, ameaças, agressões, infrações penais e toda a sorte de atividades ilícitas".
Com a nova prorrogação, os autos retornam à Polícia Federal para que as diligências pendentes sejam finalizadas e o relatório final seja apresentado à Corte. Além da PF, a Procuradoria-Geral da República (PGR) também foi notificada da continuidade das investigações.
