Segundo o ofício, no caso Master, a negativa do ministro ao acesso às provas obtidas durante as investigações, restringindo à PGR, e depois liberando os peritos da PF, fez com que os investigadores precisassem "recorrer de órgãos externos para pedir em juízo a reconsideração, sem êxito". O documento também cita a declaração do ministro Toffoli que argumentou que a PF não tem competência para pedir a sua suspeição.
Para as associações, os pedidos da PF durante o processo de investigação têm como base elementos técnicos, "sem o olhar acusatório que pode obscurecer, nem o olhar defensivo que pode obstruir". O ofício fala que a restrição fere a independência dos investigadores em casos extremamente complexos e torna burocrático o combate à criminalidade.
