O conferente de cargas Gabriel Felipe Campos, de 31 anos, foi condenado na última quinta-feira (12), por um tribunal do júri na Serra, a 54 anos e 11 meses de prisão, por feminicídio e estupro de Edna Barreto Santos, 36, e a tentativa de feminicídio de outra mulher. As vítimas eram vizinhas do réu, no bairro Feu Rosa, e foram atraídas por ele sob a alegação de que a esposa estava passando mal, mas ela nem estava no imóvel. Ao chegarem ao apartamento, as vítimas foram atacadas.
Os crimes ocorreram há três anos, em março de 2023, em um prédio residencial. Na ocasião, testemunhas contaram que Edna morava no terceiro andar, e Gabriel no primeiro. Para atraí-la, ele pediu ajuda, dizendo que a esposa não se sentia bem. Quando Edna entrou para tentar prestar algum auxílio, foi capturada e levou seis facadas. Após fazer a primeira vítima, o conferente chamou uma vizinha do segundo andar com a mesma alegação de que a esposa precisava de ajuda. Ao chegar na porta do imóvel, a mulher foi puxada pelo pescoço, mas conseguiu se desvencilhar de Gabriel e gritar por socorro.
No julgamento, conduzido pela juíza Lívia Regina Savergnini Bissoli Lage, da 3ª Vara Criminal da Serra, a defesa tentou retirar a acusação de feminicídio, tratando o crime como homicídio simples, e pediu a absolvição para o caso da tentativa. Contudo, os jurados seguiram o entendimento do Ministério Público, que apresentou a acusação contra Gabriel Felipe, e levaram à sua condenação pelos crimes de feminicídio, estupro e a tentativa.
Edna, segundo consta nos documentos do julgamento, foi morta após ser vítima de violência sexual. Ela já havia relatado para testemunhas que Gabriel a assediava. A sentença reforça que os crimes foram qualificados (sem possibilidade de defesa da vítima e feminicídio), resultando em uma pena elevada devido à gravidade das circunstâncias.
Após a condenação pelo júri, no momento de definir a pena, que deve começar a ser cumprida em regime fechado, a juíza considerou o comportamento e as características de Gabriel fundamentais para elevar a punição, entre as quais a personalidade manipuladora, o sofrimento imposto às vítimas e à gravidade do meio utilizado para o crime, isto é, o uso da faca.
Embora ainda caibam recursos para a condenação, Lívia Regina Lage decidiu pela manutenção da prisão preventiva de Gabriel Felipe devido à magnitude dos crimes e à periculosidade do conferente. Edna deixou uma filha, na época com cinco anos.
No início da semana, o tribunal do júri da Serra também condenou Reginaldo Pereira de Souza por feminicídio. Ele recebeu uma pena de 29 anos e 22 dias de prisão pela morte da mulher, a autônoma Edina Martins de Souza Gimenez, 39, na manhã de 1º de janeiro de 2020. Os dois estavam separados havia três meses, mas ele não aceitava o término da relação e a matou com uma facada no peito, no bairro Lagoa de Jacaraípe.
Assim como no caso de Gabriel Felipe, a juíza Lívia Regina Lage considerou, ao definir a pena, que Reginaldo deve cumprir a sentença inicialmente em regime fechado, e que não há possibilidade de substituição por pena restritiva de direitos ou condicional, devido ao tempo de prisão estabelecido.
Para a magistrada, é necessário manter a prisão preventiva de Reginaldo, tanto pela gravidade do crime quanto pela periculosidade que ele oferece, assim como pelo fato de o réu ter fugido logo depois do feminicídio. Edina deixou duas filhas — a caçula é fruto do relacionamento de 11 anos com Reginaldo.
