Supreme Court orders annual updates to existential minimum amount

The Supreme Court decided that the existential minimum amount should be updated annually. The existential minimum is the portion of income that remains protected in debt renegotiation processes. The decision was made during proceedings on decrees that regulate the Over-indebtedness Law.

The Overindebtedness Law (Law 14.181/2021) established the concept of existential minimum to protect consumers who cannot pay their debts without compromising their own subsistence. The current value of R$ 600 was set by decree by President Lula in 2023, after being initially fixed at R$ 303 by the previous government.
