The conviction stemmed from unauthorized use of a photograph of Guilherme Boulos (Psol-SP) taken by photographer Peter Leone. Zambelli used the image in a 2021 social media post without the author's authorization. The lawsuit was filed by Leone, represented by Sobania Advogados law firm.

The court order states: "Issue a writ of attachment, evaluation and notification. The bailiff must list the assets found, even if he understands they are not subject to attachment." During the proceedings, Zambelli's defense claimed to have maintained contact with a company that allegedly owned distribution rights to the image, but failed to provide supporting documentation.
