Brazil's Superior Electoral Court (TSE) unanimously upheld the removal of Votorantim (SP) mayor Fabíola Alves da Silva (PSDB), deputy mayor Cesar Silva (PSDB) and councilman Pastor Lilo (MDB) for political and economic abuse of power through using a church for electoral promotion. The decision, published May 18, 2026, confirmed a lower court ruling on the 2024 election case.

Reporting Justice Antonio Carlos Ferreira noted that "religious structure and authority were deliberately instrumentalized as a platform for electoral promotion" when the pastor declared from the pulpit that Votorantim's Foursquare Gospel Church was "closed" with the candidates and mentioned a project to "elect 120 councilmen" in the elections. The TSE ruled the statements "immediately dismiss any pretense that the event had exclusively spiritual character."

The decision reaffirms 2020 jurisprudence rejecting autonomous "religious power abuse" as a legal category, but establishes that using religious structure and authority can constitute political or economic abuse when deviation of purpose and impact on electoral equality are demonstrated. The TSE requires "interweaving" — acts through churches must be associated with established forms of power abuse to constitute electoral violations.

Beyond the service with "undeniable electioneering character," the TSE deemed irregular a 34.1% increase in rent paid by city hall to the church during election year "without proper justification," contrasting with just 2.45% increase in a similar contract during the same period. The removed politicians face eight-year ineligibility.
